SALEM – A Waltham man facing charges of child rape, molestation and providing minors with pornography remains free on his own personal promise to return to court with the condition he stay away from the two minors involved in the case pending the outcome of his trial.Jeffrey C. Benger, 35, of 5 Norumbenga Terrace appeared Wednesday morning in Salem Superior Court for his arraignment, pleading innocent to two counts of rape of a child with force, five counts of indecent assault and battery on a child under the age of 14 and three counts of dissemination of pornography to minors.Judge Timothy Q. Feeley agreed to release Benger on personal recognizance at the joint recommendation of Assistant District Attorney Colleen Cashman and defense lawyer Samuel B. Goldberg.Special conditions concerning the terms of release are that Benger is to stay away and have no contact with the two children involved in the case.The allegations are based on incidents in Marblehead on diverse dates from July 1998 through December 2006.The case began to unfold on May 12 of this year when one of the children and his grandmother met with Marblehead Police Sgt. Marion Keating and Cashman, as well as a victim advocate, telling them that the incidents began when the victim was about 6.At the time, Benger lived across the street from the boy and had been babysitting him.Two years later, Benger moved into the basement of the victim’s grandmother’s home where the boy and his sister lived. Benger lived there for about six years before moving.The boy reportedly told authorities that Benger showed him pornography, molested him and made him perform a sex act on Benger. The sexual encounters apparently dated back to 1998 through 2002, according to reports.The victim told police as time went on he learned in health class that what Benger was doing to him was wrong and refused to have any more sexual involvement with him.As the investigation evolved, authorities learned that Benger allegedly molested and raped a young Marblehead girl during a span that began in 2000.The penalty for rape of a child with force carries a potential life sentence in state prison, indecent assault and battery on a child under age 14 carries up to 10 years and dissemination of pornography to minors carries up to five years in state prison.Benger is due back in court on Sept. 21 for a pretrial conference.
