SALEM – A Swampscott man who allegedly stabbed a co-worker eight times outside a Taco Bell in July was indicted Friday afternoon by an Essex County grand jury.Chaz Lee Burton, 21, of 9 Elliott St., faces charges of armed assault with intent to murder, assault and battery with a dangerous weapon causing serious bodily injury as well as seven counts of assault and battery with a dangerous weapon, a knife.The charges arise from an incident on July 17 at 267 Highland Ave. in Salem, when Burton allegedly stabbed a fellow Taco Bell employee in the parking lot at around 4 a.m. after they worked the late shift.The victim, 23-year-old Derrick Cusumano of Beverly, was stabbed once in the face and seven more times in the torso area, one stab wound piercing his lung. Cusumano was first taken to Salem Hospital and then transferred to Massachusetts General Hospital in Boston where he spent a week after undergoing surgery.A short time after the incident, Burton showed up at Salem Hospital for emergency treatment for a stab wound. Staff members at Salem Hospital contacted police saying there was a suspicious man inside the emergency department. Police responded to the hospital and arrested Burton after a brief investigation.Investigators said they found Burton’s car in the parking lot and a bloody knife was found inside.It is unclear what the two men were fighting over, but investigators believe that Burton attacked Cusumano as he was walking to his car after the pair had gotten into a fistfight earlier that night.The indictments handed up now move the case from Salem District Court, where Burton has pleaded innocent, to Salem Superior Court, where he will be re-arraigned within a few weeks.Burton was found to be a danger following a hearing in Salem District Court by Judge Robert Brennan, but the judge agreed there were conditions of release to ensure the safety of the public. Brennan ordered a $10,000 cash bail with the condition if Burton makes the bail he is to be on house arrest with a bracelet monitoring device.It is not known if he made the cash bail.Assistant District Attorney James P. Gubitose is prosecuting the case for the commonwealth.
