SALEM – A Lynn man caught driving drunk for his fifth time is considered a danger but remains free on $1,000 cash with specific terms including a curfew and no alcohol consumption following his arraignment in Salem Superior Court.Christopher Smith, 46, of 2 Mace Place, #2, Lynn, pleaded innocent Monday to a single charge of driving under the influence of alcohol, a fifth offense, before Judge Robert A. Cornetta.Smith was earlier found to be a danger in Lynn District Court following his arraignment there. The indictment handed up now moves his case to Superior Court, where he was re-arraigned Monday morning.The conditions are that Smith is to remain alcohol free, consent to random sobriety screenings, not drive, surrender his license plate and registration, report as directed to probation, remain living at 2 Mace Place and is confined to the home between 8 p.m. and 7 a.m. until his case is resolved.Authorities say Smith backed his pick-up truck into another vehicle on Baltimore Street at about 11:28 a.m. on March 23.Witnesses told authorities that Smith was stumbling when he exited his truck.Lynn Police Officer Ryan McDermott responded to the scene of the accident and arrested Smith after he apparently failed to perform several sobriety tests.Smith has four previous operating under the influence of alcohol charges. His last offense was in 1998 out of Lynn District Court.He is due back in court on Oct. 19 for a pretrial conference.
