LYNN-A Lynn man has brought a lawsuit against the Lynn City Council for granting a special permit to a developer allowing the conversion a pre-existing condominium complex on Mt. Vernon Street from 32 to 49 units.Jonathan Bedard, the manager of the 90 Exchange St., condominium complex and owner of three units, filed the court action Friday in Salem Superior Court against Mayo Group Development of Boston and members of the Lynn City Council, maintaining City Councilors decision to allow the conversion was “unsupported by evidence and is legally untenable.”According to the complaint, in 2004, Mayo Group Development was granted a special permit by members of the City Council to convert property at 24 Mt. Vernon St., into a 32-unit condominium complex.Then in September Mayo Group Development filed a petition to amend the permit to increase the number of units from 32 to 49. City Councils approved the petition in October.Bedard, who lives in Unit ULL3 at 90 Exchange St., abuts to the rear of the Mt. Vernon Street condominiums and feels the conversion will jeopardize the property.He wants a judge to annul the decision allowing the conversion and award any such relief as deemed appropriate.Attorney George E. Richardson of Swampscott filed the complaint in behalf of Bedard.
