$50K bail for Saugus suspect who filmed rape

SALEM – Bail for a Saugus teen facing a potential life sentence for raping an underage Swampscott girl was set at $50,000 cash.Kyle Fuchs, 19, of 41 Richards St., Saugus, pleaded innocent at his arraignment Thursday morning in Salem Superior Court to two counts of statutory rape and two counts of exhibiting a child in nudity.As jointly recommended by the prosecutor and defense, Judge Howard J. Whitehead set the same bail amount as set earlier in district court and continued the case to March 18.Assistant District Attorney Greg A. Friedholm told Whitehead that he has turned over to defense lawyer Patrick W. Morgan all materials he has available at this time about the case.However, Friedholm said that the commonwealth is currently conducting a forensic examination of Fuchs’ computer and that report will be generated in the near future for him. He will then turn over the report findings to Morgan, as part of preliminary discovery motions when it is available so he can then file preliminary trial motions for suppression.The allegations pertain to incidents between April 1, 2006 and April 1, 2007 at Swampscott and Saugus when Fuchs apparently was engaged in sexual activity with a 14-year-old girlfriend.The relationship between the underage teen and Fuchs lasted about a year before they ended their involvement.The victim, a Swampscott resident, reportedly told authorities that Fuchs liked to take photos of her performing sexual acts on him, but said he told her the pictures were only for his use.She later discovered that Fuchs had allegedly posted illicit photos of the underage girl on the popular Web site, MySpace.Fuchs was arrested Nov. 30 when he turned himself in to Swampscott police after authorities had executed a search of his father’s Saugus home and obtained evidence and Fuchs’ computer.Fuchs previously was convicted of two counts of indecent assault and battery on a child over 14 on September 2006. He was 17 years old at the time and his victim was 15. He is currently on probation for those charges.Fuchs faces a potential life sentence on each of the child rape charges.
