REVERE – When his mother refused Cory Roche?s request Monday to help him prepare his income tax form, the pair argued and the 23-year-old fatally stabbed Lisa Bryson Roche.Prosecutor Mark T. Lee outlined that scenario Tuesday afternoon as Cory Roche was arraigned in his hospital bed at Massachusetts General Hospital where he was listed in fair condition.Roche pleaded not guilty to the charge of murdering his mother and armed assault with intent to murder Revere Police Officer James Rose.Judge Timothy Gailey ordered Roche held without bail until a March 28 court hearing in Chelsea District Court.Rose responded to 35 Fernwood Avenue at 3:15 p.m. Monday after police received an emergency 911 call. He confronted Roche, ordered him to drop the knife and, when Roche refused to do so, shot him once in the chest.Lee said Lisa Roche was home with her adult daughter, 17-year-old son, 6-year-old daughter, 2-year-old daughter and the adult daughter?s fiancé when Cory Roche arrived at the first floor apartment and asked her to help him with his taxes.She said she could not help him and Roche became angry before stabbing her multiple times.?The other children heard screaming,” Lee said.During the arraignment, Roche complained he could not breathe as he lay in a hospital gown partly reclining on an intensive care unit bed.?I?m not talking to you,” he shouted after Gailey asked Lee to outline the charges against Roche.Roche will be taken to the Nashua Street jail in Boston after doctor?s release him from the hospital. Defense attorney Robert Wheeler said he needs to interview Roche in anticipation of the March hearing.?It was difficult today. He was in physical and mental distress,” Wheeler said.Cory Roche has a court record that includes two charges of assault and battery with a dangerous weapon filed in Chelsea District Court in 2004. He was arrested at the Swampscott train station in October 2005 on an outstanding arrest warrant related to the assault charges.Patrolman Michael Frayler spotted Roche pacing the commuter rail platform just after midnight on Oct. 27, questioned him and found a small amount of marijuana in Roche?s possession.Roche was placed on probation in March 2006 with conditions including a mental health evaluation stipulation that he not take drugs “with the exception of prescribed drugs.”Court records listed Roche as homeless at the time of his arrest while subsequent records listed an address in Charlestown and another at 16 Parker Avenue, Apt. 3 in Lynn.Suffolk District Attorney?s spokesman Jake Wark was not aware of domestic assault charges or restraining orders filed by the mother or son.
