Lynn men shot at during car break arraigned

LYNN – Two city men were arraigned Tuesday for breaking into a car on Mall Street early Sunday moments before they were grazed with bullets.Richard Dalton, 22, of 514 Eastern Ave. #1 and James A. Hubert, 19, of 16 Fernwood Ave., were charged with breaking and entering into a vehicle and receiving stolen property.Shortly after 3:30 a.m. Sunday, officers responded to the area of 55 Mall St. on reports of gunshots fired. There, police found Dalton was grazed in the shoulder and Hubert was grazed in the hip near a car riddled with bullets. Both men declined medical attention.Police say the men told two completely different stories when asked why they were on Mall Street.Dalton allegedly said he was walking home from a party when he ran into Hubert. Suddenly, two black males allegedly approached and started shooting.However, Hubert said he and Dalton were sitting inside a car when two unknown black males shot at them, according to police.Police found the men in the driveway of 55 Mall St. when officers arrived. A neighbor told police one of the men kept yelling, “I’ve been shot!”The resident of 55 Mall St. said she was hosting a party during which both Hubert and Dalton were present, police said.A neighbor told police that when the shots were fired, he looked outside and saw Hubert and Dalton running away from the parked car that had been hit with bullets, according to police.The owner of the vehicle was found inside 55 Mall St. and said no one had permission to use the vehicle, police said.After the men were arrested for breaking into the car, police found a car stereo faceplate in Hubert’s possession. Police also found an iPod and two credit cards in Dalton’s possession that were allegedly stolen from the car, along with a bullet in his right jacket pocket near where he was grazed.The men were ordered back to court May 27 for a pre-trial hearing. Hubert was ordered held on $2,500 cash bail and has a record for serious offenses.In October, he was charged with three counts of larceny after he allegedly stole his stepfather’s checks and wrote them out to himself.In one instance, Hubert allegedly tried to cash the check at a Salem bank. When the teller accused him of forging the signature, Hubert allegedly got nervous and fled the bank – leaving his driver’s license behind.In August, he was summonsed to court for assault and battery after he allegedly struck his stepfather during an argument.Dalton also has an open court case for assault and battery after he allegedly broke a teenager’s nose in Swampscott while trying to steal the victim’s cell phone in August 2006.
