Sex offender who failed to register twice sentenced to five years in prison

SALEM – A 25-year-old local sex offender who failed twice to register and report his change of employment was sentenced to five years in state prison.In Salem Superior Court Tuesday afternoon, Francisco Delgado, whose last known address was 12 Ward St., #1, Salem, avoided a trial by pleading guilty to failing to register as a sex offender, subsequent offense, and failing to properly report a change of employment before Judge David A. Lowy.The judge sentenced him to the agreed recommendation offered by prosecutors and defense.Assistant District Attorney Jana DiNatale said she was prepared to show at trial that Delgado violated the sex offender law by not annually reporting to Salem police his residence and failed to report a change of his employment while working at Atlantic Toyota in Lynn on dates between Dec. 1, 2006 and June 5, 2007.Delgado, formerly of Peabody, was also found in violation of his probationary terms involving his failure to register as a sex offender in 2005 when he moved to Salem and was given a 30-month sentence by Lowy.Additionally, the judge found he violated his probationary terms involving a second 2001 case in which Delgado pleaded guilty to sexual misconduct with a 14-year-old girl he met while chaperoning a dance at the Salem YMCA. The incidents took place at his home then at 1 Broughton Road in Marblehead and also at another home in Salem. Lowy sentenced him to five years in prison.But both of the probation violation sentences imposed by Lowy on Tuesday will be served simultaneously, instead of one after the other, along with his newest five year term of incarceration imposed for failing to register as a sex offender and failing to report a change of his employment.The judge ordered Delgado to be on lifetime community parole supervision.He has been in custody since his arrest and will receive credit for that time served awaiting his trial.
