MARBLEHEAD – A Peabody man did everything he could to get out of his fifth OUI charge on Saturday, according to Marblehead police.Mark H. Weiss, 53, of 6 Aspen Lane, was arrested and charged with operating under the influence of liquor at the corner of Lafayette and Maple streets at about 5:30 p.m. Saturday following a motorcycle accident.Once he was arrested after failing several field sobriety tests and could barely stand up, Weiss begged police to let him go, police said.At one point, he told an officer he was a Marblehead native and offered him $1,000 cash to free him, police said.Then, when he was taking a breath test at the Salem police department – the Breathalyzer at the Marblehead police department had malfunctioned – he allegedly pretended to blow into the device and told officers the machine wasn’t working.According to a police report written by Officer Eric Osattin, Weiss was “pretending that he was giving breaths.””Mr. Weiss then began to argue that he was blowing and that the machine is broken and that we were manipulating him,” Osattin wrote.Lynn District Court Judge Michael Uhlarik wasn’t joking around at Weiss’ arraignment Monday. Due to tougher regulations from Melanie’s Law, Uhlarik deemed Weiss a danger to the public and held him in jail without bail until a pre-trial hearing is scheduled for Aug. 11.Weiss’ motorcycle fell over after he apparently hit a curb in the accident, but he was not injured, police said.Weiss allegedly told police he had a beer at the Rip Tide bar in Marblehead shortly before the crash.
