LAWRENCE – A Superior Court jury needed less than one hour to convict a Quincy man of stealing jewelry from a home in Saugus in 2007.Kurt Palluccio, 31, who last lived at 130 Brook Road in Quincy, went on trial this week in Lawrence Superior Court on charges of breaking and entering in the daytime with intent to commit a felony and larceny from a building.He was sentenced to serve 8 to 10 years in state prison by Judge Richard E. Welch, III, who said as he imposed the penalty that Palluccio is “definitely a danger to society.”Assistant District Attorney Jean M. Curran presented evidence during the two-day jury trial that it was about 4:20 p.m. on July 16, 2007 when Saugus police were dispatched to a possible burglary at 10 Summer St.A concerned neighbor spotted a suspicious vehicle in the neighbor’s driveway and called the homeowner at work, who immediately alerted police.When they arrived they saw Palluccio in the home as he dove through a window to exit the house and was arrested.Several items of jewelry were found on Palluccio by police. The homeowner later identified the items and said the jewelry was inside a jewelry box in a bedroom in her home.Entrance to the home was gained through a front window and screen. Another screen was forced open at the rear of the house, police said.His accomplice, Stacy Lynn Smith, 37, also of Quincy, was arrested about a half hour later driving the described white Ford Taurus getaway vehicle.She pleaded guilty to her role in the crime earlier and received nine months in jail, deemed served, and was placed on probation for five years with inpatient drug treatment.Curren felt a longer punishment was appropriate, suggesting nine years in prison.Palluccio never took the stand in his own defense, but maintained he was innocent of the crime.The judge credited Palluccio the 492 days he has spent in jail awaiting trial on the case.
