LYNN – The Roxbury man who allegedly stabbed another man during a road rage-fueled attack on Route 1 in Saugus and his girlfriend, a Saugus woman, were ordered held without bail Thursday in Lynn District Court.Judge Stacey Fortes-White ordered Gilberto Perez, 41, of 71 Clifford St. #23, Roxbury and Diane McGilvery, 39, of 9 Broadway #213, Saugus, to remain behind bars until a dangerousness hearing is held next Thursday. Both pleaded innocent to charges of armed assault with intent to murder and assault and battery with a dangerous weapon.Perez has a 10-page criminal record filled with assault, drug and motor vehicle charges dating back to 1984.In court, prosecutor Jen Kirshenbaum said Perez has served “a lengthy amount of time out of Norfolk Superior Court for breaking and entering and other charges.””We believe there are no terms or conditions of release to ensure the public safety,” Kirshenbaum said.State and Saugus police said Perez was found at his girlfriend’s Saugus apartment shortly after the 12:47 p.m. attack Wednesday and officers noticed blood on his shirt. Perez told them he cut himself shaving, then changed his story and said he cut himself working on a car. He later acknowledged that he was in a fight on Route 1 but didn’t admit to the actual stabbing, authorities said.Stabbing victim Richard Barbarisi, 25, told police a raspberry-colored sports utility vehicle cut him off near Main Street as he was driving north on Route 1. He pulled over to the side of the road along with the SUV and said a man got out of the SUV and began yelling at him.”The assailant then reached into his pocket and pulled out a silver pocket knife and started slashing at the victim. Barbarisi grabbed the arm of the assailant and grabbed his hair,” State Trooper James Gill wrote in his report, adding that McGilvery joined in the fight.”At this point the female operator, described as having funny teeth, like big teeth, began grabbing and kicking Barbarisi,” Gill wrote.Barbarisi was slashed on his right bicep and chest. He did not initially seek medical help but was subsequently advised by Gill to do so.McGilvery was identified as the driver and also charged with negligent operation.Public defense attorney Rebecca Whitehill said the defendants gave a different version of events, claiming they were cut off on the highway before the alleged victim stopped his car in the left hand lane before the fight started. Both cars had left the area before police were called.Perez’ court record includes a 2008 restraining order, a January 2007 assault and battery charge, a 2001 charge of assault and battery with a lit cigarette and a 1996 assault on a prison guard.
