Marblehead committee approves ethics code

MARBLEHEAD – The School Committee reorganized Thursday evening and managed to approve their Code of Ethics without a negative vote.The new chairman of the committee is Dick Nohelty, who is in the second year of his first term. Former Chairman Amy Drinker will serve as vice chairman and Patricia Blackmer will serve as secretary.Committee member Jonathan Lederman expressed reservations about three items in the committee’s Code of Ethics. On the recognition and support for the administrative chain of command and refusal to act on complaints as an individual, Lederman said, “We frequently get complaints and there is a time when it is necessary to remedy them.”On the code requirement to act only on the superintendent’s recommendation in all matters of employment or dismissal, he said, “We can responsibly disagree with the superintendent.”On the code’s ban on statements or promises regarding his committee votes, Lederman said, “When people ask what our position is we ought to be free to say.”When Drinker told him, “I think that’s wrong,” and pointed out that he had never tried to change the wording on those items, Lederman said he looked forward to discussing them at a future meeting. “I felt over the years I was inconsistent,” he said, “but I didn’t have the feeling it would be a fruitful discussion given the makeup of last year’s board.”Nohelty told him the code is “a guideline for us to follow” and Blackmer reminded him, “We do have a chain of command.”Last year Lederman voted against the code. This year he abstained from voting.”I fully expect to comply with all laws,” he said. “My first duty is to my constituents.””We represent the entire town,” Nohelty told him. “We don’t have constituents.”
