SALEM – A Marblehead man who claims he was seriously injured when the drunken driver of a car he was in crashed on Route 1 last year is suing the driver and the Cabaret Lounge in Peabody for serving them too much beer before the crash.Matthew Bisegna, 30, of Marblehead filed the negligence court litigation this week in Salem Superior Court naming his friend and driver of the vehicle, Michael Urany, 34, of Nahant, and the Cabaret Lounge, located at 95 Newbury St. in Peabody, responsible for his injuries sustained in a crash on Route 1 on the evening of Jan. 20, 2009According to the court complaint, Bisegna and Urany began drinking in the midmorning at the Cabaret Lounge and then before noon went to another strip club, the Squire Lounge in Revere, splitting pitchers of beer.They returned to the Cabaret Lounge after drinking most of the day, where Urany said in a deposition filed with the lawsuit, he began vomiting into his hand at the bar.He then proceeded to the men’s room where he again vomited. After returning to the bar, the bartender allegedly told Urany “throwing up is like hitting the reset button,” but then sold him another pitcher of beer, according to his deposition.After the two men left the establishment, Urany crashed his 2001 Malibu and struck another car and guardrails on both sides of Newbury Street, Route 1 in Peabody and Lynnfield. Bisegna was thrown from the vehicle and was found lying on the road when police arrived at the scene.Urany fled from the scene. He was arrested a short time later on Route 129 in Lynnfield by police. He had a blood-alcohol level of .13.Urany pleaded guilty last November to drunken driving causing serious bodily injury and is now serving a jail term.Attorney Donald R. Bumiller of Lynn filed the complaint on behalf of Bisegna.He lists in the court documents a total of $93,167.81 for Bisegna’s medical, hospital, physical therapy, lost wages and future medical expenses and seeks reimbursement for those expenses.A trial before a jury is requested from the court.
