MARBLEHEAD – The owner of a controversial $1.1 million home at 74 Bubier Road has had another court setback in a 15-year lawsuit filed by a neighbor who wants the house razed.For the second time in five months Building Inspector Robert Ives has ordered Wayne Johnson to raze his house, based on Land Court Judge Charles Trombly Jr.’s refusal to reconsider a January order to raze the building.Johnson could not be reached for comment.John Schey, who lives next door to the Johnsons, has been seeking the removal of the Johnson house since it was built.Johnson subdivided his property at 76 Bubier Road in 1995, sold his former home at that address and built the second house at 74 Bubier Road.Schey sued him in Land Court, claiming that the house lot Johnson created was illegal, and won his case.So far, getting the house torn down – or moved to another lot – has been a different matter. In fact, Schey’s lawyer, Attorney Mark Bobrowski, admitted in January that if the Land Court ruled against Johnson he has two other possible avenues of review by the Massachusetts Appeals Court, which he said could hear arguments in a month and make “a quick decision” thereafter.
