NAHANT – An illegal immigrant released on bail Sunday as police waited for a return call from federal immigration officials has been taken into custody.Police Lt. Thomas Hutton said Jose Osmin, 35, of 63 Franklin St., Lynn, was charged with unlicensed operation of a motor vehicle after he was initially pulled over for “traffic violations.” Hutton declined to comment on what those alleged violations were.”The individual was arrested by Officer Timothy Furlong and brought to the station for processing,” Hutton said. “He was fingerprinted and his prints were run through the system. ICE (Immigrations and Customs Enforcement) was contacted immediately and we didn’t hear back from ICE until 7:30 on Sunday morning – that was hours later. By that time the individual had already been bailed out and released.”Hutton said local officials could only detain undocumented immigrants when directed to do so by ICE. He said on Sunday morning the agency informed Nahant police that an officer was not available to pick up and detain Osmin.”When ICE called back, they said they didn’t have the manpower to pick him up,” he said. “ICE said if the agency had manpower available when he appears in Lynn District Court he would be picked up there.”Essex District Attorney spokesman Steve O’Connell said there were two unlicensed operation charges pending against Osmin.”ICE was in Lynn District Court with a detainer,” O’Connell said. “We dropped the unlicensed operation charges and ICE took him into custody.”Calls to the Boston ICE office were referred to the Newark, N.J. office. Calls to that office were not immediately returned Tuesday.
