SALEM – A Lynn man authorities say conspired to burglarize a CVS Pharmacy remains free on his own personal recognizance after pleading innocent.James Barr, 44, of 15 Moon Road, appeared for his arraignment Tuesday in Salem Superior Court, pleading innocent to a charge of conspiracy before Judge John T. Lu.As jointly proposed by Assistant District Attorney James P. Gubitose and defense lawyer Kirk W. Bransfield, the judge agreed to set the same terms of release as previously established in Lynn District Court and continued the case to March 4 for a pretrial conference.Authorities say that Barr, along with his alleged accomplice, John Donovan, 44, of Danvers, plotted a break-in to steal pills from a CVS Pharmacy in Tewksbury.They apparently met mid-day on July 26, 2009 in the parking lot of the Dunkin Donuts at Goodwin’s Circle in Lynnfield to plan the crime.Donovan pleaded innocent to his role last month and is currently held at the Middleton Jail in lieu of $10,000 cash. Donovan also has other pending burglary charges arising out of a break-in at a Walgreen’s Pharmacy in North Andover where various pills were stolen. He had denied those allegations also and awaits trial on the case.
