LYNN – A blockbuster snowstorm forced the cancellation of Tuesday’s disciplinary hearing for Chief Financial Officer Richard Fortucci.Fortucci, suspended Jan. 4 with pay by Mayor Judith Flanagan Kennedy, was to face a hearing before the City Council to determine if he should be fired for allegedly failing to adequately perform his fiduciary duties.According to Terry Young, executive secretary to the City Council, the special council meeting was canceled shortly after 3 p.m. with the consent of all parties. “The attorneys for the mayor and for Mr. Fortucci have agreed to continue the hearing until next week,” she said.The hearing at City Hall is rescheduled for Tuesday, Feb. 8, in the council chamber at 7 p.m. Council President Timothy Phelan will preside.”Council President Phelan postponed the meeting because of the weather. All other city meetings, including cemetery and parks, have been postponed as well,” said Claire Cavanagh, the mayor’s aide.Lynn schools were ordered closed today as another winter storm threatened to dump a foot of snow on the clogged streets.As the weather worsened Tuesday, Phelan said he contacted the Law Department for an opinion on continuing the hearing because Feb. 1 was the last day it could be held under provisions of the city charter.”I spoke with the Law Department and was told the only way for this hearing not to go forward is if both parties agreed,” he said. “It was reported back to me that they filed a joint motion to have the hearing continued because of the weather.”When the Fortucci hearing resumes, the mayor will be represented by city-hired labor contract lawyer David Grunebaum, Fortucci by Ronald Ranta and the City Council by the Law Department.Phelan noted Grunebaum lives in Sudbury and expressed concern Tuesday the hearing would recess late into the evening as the storm reached a fury, making travel difficult.Documents on file at City Hall indicate the mayor questioned Fortucci’s professional abilities when it was discovered the city incurred over $2.1 million in increased costs, allegedly because the chief finance officer botched insurance policies and workman’s compensation procedures. The mayor also has alleged Fortucci fumbled payroll matters, was verbally abusive to his staff and created a hostile work environment.Six city councilors must vote to terminate Fortucci. Comptroller John Pace is serving temporarily as chief financial officer.Fortucci complained last week he has not seen a shred of evidence to support the allegations. Once suspended from office, he requested the hearing. Had Fortucci not contested the mayor’s decision, he would have been terminated after 21 days.
