LYNN – The Brickett Elementary student who claims to have been pushed down a flight of stairs by a bully in 2008, and is now paralyzed as a result of his injuries, is suing the city of Lynn, North Shore Medical Center, the school department and the alleged bully on 10 separate counts of negligence.According to the lawsuit, in March 2008, Matthew Mumbauer was an 11-year-old student at Brickett in Nancy Doherty’s fourth-grade class. While Mumbauer was a student at the school, he claims to have been subjected to “frequent, constant, heinous and widely known bullying and harassment” by a small group of students, including classmate Brian Jean-Francois.During that time, Mumbauer and his parents say they voiced complaints to teachers, administrators and staff at the school. However, on March 10, Mumbauer, according to the lawsuit, was violently shoved on a school stairwell by Jean-Francois, causing him to fall on the stairs. A few hours later, he started to complain about an injury, but school officials allegedly failed to call emergency services.That afternoon, Mumbauer’s parents took him to North Shore Medical Center for an evaluation, where he was seen by Dr. Linda J. Morgan and Ethel Wu, a third-year medical student. While at NSMC, an X-ray was taken of Mumbauer’s right knee, where no abnormalities were found. He was sent home with a sprain of his right foot and pain medication.Then, on March 12, Mumbauer returned to NSMC, where he complained of being unable to move his hands or legs and was later transferred to Massachusetts General Hospital in Boston. While there, he was diagnosed with an injury to his spinal column and spinal cord, which resulted in the onset of quadriplegia.Since then, the lawsuit claims Mumbauer, now 14, is permanently paralyzed, is confined to a wheelchair and has accrued at least $850,000 in medical bills and expenses.NSMC spokesman Kevin Ronningen said the hospital is not at liberty to comment on the case as it remains pending. Calls placed to Mumbauer’s attorney, Donald Grady and the Superintendent of Lynn schools Catherine Latham, were not returned as of press time Wednesday.
