Lynn man files suit to prevent home demolition

LYNN – A Lynn property owner whose building on Eastern Avenue has been scheduled for wrecking has turned to Superior Court to halt the demolition.Estaban L. Acosta, of 4 Crosby St., Salem, filed the court action Friday seeking to have the City of Lynn prohibited from demolishing property he owns at 394-396 Eastern Ave.On or about Sept. 28, 2010 the city of Lynn, through the City Council, issued an order for the demolition of the building.Acosta accuses the City of Lynn of failing to properly give notice of their intent to issue the order.He maintains the building is not burnt, dilapidated, dangerous or otherwise a nuisance.Attorney David J. O’Esperance, who filed the court action on behalf of Acosta, seeks to have a judge issue a restraining order with a permanent injunction to follow prohibiting the City of Lynn from demolishing the building.
