April 8, 2011 by Robin Kaminski

LYNN – An early morning wake-up call to go to a methadone clinic allegedly angered a Lynn man to the point where he flew into a rage, hurled a children’s toy at his girlfriend’s head and trashed their apartment on Thursday. The suspect, Richard Botelho, 40, of 70 Rogers Ave., #3, was charged with assault and battery with a dangerous weapon, children’s toy, and domestic assault and battery. He was arraigned at Lynn District Court by Judge Antoinette Leoney and ordered held in lieu of $1,500 cash bail. A pre-trial hearing is scheduled for May 2.According to court documents, police responded to a report of a fight in the attic of a home on Rogers Avenue, around 4 a.m. Upon arrival, police found a 32-year-old woman upset and crying, who said she had just woken up her boyfriend, Botelho, to go to the methadone clinic and he flew into a rage. She alleged that Botelho became extremely upset, grabbed a nearby children’s toy, a stuffed horse with wooden wheels on the bottom, and threw it at her head. After trying to run out of the room, the victim said Botelho chased after her and allegedly grabbed her by the arms before he turned his aggression onto household items, smashing lamps, picture frames and other items.Police say the apartment was in total disarray with broken glass strewn on the floor and pictures knocked off of the walls. The victim said Botelho was receiving a social security check due to a “fake illness” and that he was “stealing money from the government and wasn’t really sick.” She also told police that Botelho was getting treatment at the methadone clinic everyday, but alleged that he is “shooting heroin on the side.”Police later learned that the attic apartment the two are living in, is actually an illegal residence of a two-family home. In addition, police were unable to locate a sprinkler system, which is required by code, and said there are only two electrical meters for three apartments. The Lynn Inspectional Services Department was notified of the matter, along with the Fire Department.
