SALEM – Authorities say a Marblehead man had open bottles of alcohol in his truck after being arrested in Swampscott for his fifth drunk-driving offense. He was arraigned Thursday afternoon in Salem Superior Court and remains held at the Middleton Jail without bail pending a dangerousness hearing.Terence P. Driscoll, 39, of 14 Baldwin Road, pleaded innocent to operating a motor vehicle while under the influence of alcohol, fifth offense, operating after suspension of his license, subsequent offense, resisting arrest and two counts of assault and battery on two police officers.Assistant District Attorney Jessica Strasnick, who maintains that Driscoll poses a danger to the community, filed papers asking Judge Timothy Q. Feeley to detain Driscoll pending a dangerousness hearing.Feeley acknowledged the petition and set down a hearing date of June 6. In the meantime, Driscoll is being held without bail.Shortly before midnight on Jan. 14, Swampscott police responded to a motor vehicle accident in which they found Driscoll’s 1995 Dodge Ram truck stuck in a snowbank, still running, on Essex Street in Swampscott.Police said that Driscoll, identified as the operator had a suspended license at the time.Swampscott Police officers Michael Fraylen and Brian Wilson said he had an odor of alcohol on his breath, slurred speech, glassy eyes and was unsteady on his feet.At one point, Driscoll said he was calling Triple-A for help, but police quickly learned that the woman on the cell phone was his mother.Driscoll told police he had just come from Salem State University and, when asked to perform field sobriety tests, became belligerent. Unable to perform the tests, officers began to arrest him, but he apparently became aggressive and kicked the officers.Officers eventually had to use pepper spray to subdue him.Officers reported they found were open bottles of Smirnoff Vodka and Kahlua in the truck.Driscoll currently is serving a jail sentence for unrelated crimes, according to public defender Amanda Barker.
