Former Marblehead man indicted for child assault, endangerment

SALEM – A former Marblehead father accused of allegedly trying to kill his 7-week-old son by stuffing a baby wipe into his mouth and dropping him to the floor because he would not stop crying has been indicted by an Essex County grand jury.Assistant District Attorney Kate B. MacDougall presented evidence to a grand jury resulting in indictments being handed up Friday afternoon against Dario Finkel of Salem.Finkel 26, who had been living at 1000 Loring Ave., Salem is charged with two counts of assault and battery with a dangerous weapon on a child, two counts of assault and battery as well as a single count of child endangerment.The allegations arise out of incidents on or about April 19 when Finkel allegedly stuffed a baby wipe down his son’s throat, dropped him and threw him at his wife, because the baby would not stop crying.The indictments now move the case from Salem District Court, where Finkel has pleaded innocent to similar charges, to Salem Superior Court, where he will be arraigned within a few weeks.In the meantime, Finkel remains held without bail after being found a danger.Also indicted was Devin Sheehan Powers, 21, of Charlestown, charged with armed assault with intent to murder and assault and battery with a dangerous weapon arising out of an incident at the Middleton Jail when he allegedly stabbed another inmate in the shower on April 4.Powers currently is under indictment in Salem Superior Court for brutally attacking a developmentally disabled man and robbing him of his cell phone in Lynn on July 15, 2009.He has pleaded innocent to the allegations and currently is scheduled to go to trial on the case in September.Assistant District Attorney Michael Sheehan is prosecuting both cases.
