SALEM – A Lynn mechanic who was caught last summer photographing his uncle’s 4-year-old daughter nude pleaded guilty and received two to three years in state prison with probation and agreed to be deported back to Guatemala.Carlos Filberto Orozco, 29, last known address of 262 South Common St., #1, Lynn, made his plea Monday afternoon in Salem Superior Court to charges of rape of a child, possession of child pornography as well as posing a child in a sexual act and posing a child in a state of nudity before Judge Howard J. Whitehead.”I want to ask for your forgiveness. I came to your country illegally. The second thing is because of this problem. When I drink, I lose control. I made a mistake. I have to pay for it. It comes from my heart,” Orozco told Whitehead as he pleaded guilty.In handing down the punishment, Whitehead noted that Orozco had no prior record and felt the incident arose by an “impulse” which he told Orozco he needed to address.Orozco was sentenced to serve not less than two years and not more then three years in state prison. He has already served 337 days awaiting trial on the case.Upon his release, Orozco will be on probation for another three years and was ordered to refrain from alcohol and have random tests.However, he also agreed to be deported back to Guatemala, his native country.The charges arise out of an incident on Aug. 29 when Orozco was caught photographing his uncle’s 4-year-old daughter nude.It was around 5:30 p.m. when police responded to 262 South Common St. #1 on a report of a man photographing a young girl. The victim’s father told police he was sitting in the living room with one of his daughters when he got up to check on his wife and his baby. When he left the room his child was wearing a shirt and underwear and was alone.When he returned about six minutes later, he discovered his nephew, Orozco, kneeling on the floor in front of his daughter, who now had her underwear off, while Orozco was taking pictures of his cousin with his cellular phone.The father immediately responded, asking him what he was doing and grabbed the Apple iPhone.The father then called his sisters and police.The father said he saw six pictures of his daughter and proceeded to reportedly kick Orozco on his leg as Orozco begged for forgiveness.The cellular phone was then turned over to authorities who said they found six pictures that included close-up shots of the victim’s genitalia, posed shots of her naked in the living room and bathroom, and more.The child was later taken to North Shore Children’s Hospital for examination where she was examined. Because of her age medical professionals were unable to perform some of the examinations, but agreed she did not suffer any huge trauma to that area.When police interviewed Orozco, he admitted taking the pictures.Assistant District Attorney Karen Hopwood asked for a longer punishment of five to seven years with 10 years probation.”A 4-year-old girl is posed and a child was raped in her own home by her then 28-year-old cousin,” Hopwood emphasized as she cited the dangers of child pornography and exploitation.Although the family was not present due to work schedules and losing a day of pay, Hopwood said the father of the child felt Orozco should be punished for what he did to their daughter. Hopwood also acknowledged the incident was “related to alcohol.”Defense lawyer Mark Schmidt said his client came to the United States over five years ago, worked as a mechanic for a garage in Salem and said he was embarrassed, ashamed and felt he has betrayed all the trust the United States put in him.Schmidt said his client told him he began drinking that early Sunday morning and by 5 p.m. had drank two six packs of beer as he asked the judge to impose the punishment proposed.Orozco was indicted by an Essex County grand jury last September and has been held in lieu of bail since his arrest.
