SALEM – A Superior Court judge is recommending to the district attorney’s office that the case of a Lynn father, charged with slapping his 7-year-old son hard enough to knock him back and hit a table, should be “appropriately” heard in Superior Court, despite the defense attorney saying the charge is expected to be reduced.George Fabrizio, 33, of 215 Curwin Circle, Lynn, appealed to Superior Court regarding his dangerousness hearing in which Peabody District Court Judge Matthew Nestor earlier ruled that Fabrizio posed a “mortal danger” to his child.Fabrizio is charged with assault and battery on a child with substantial injury involving an incident on June 28.The incident occurred at an Oak Street home in Peabody.Salem Superior Court Judge John T. Lu ordered Fabrizio to remain held without bail saying “he is a danger to his child.”Lu also said he is recommending that the case be “appropriately” heard in Superior Court as he cited prior history of severe bruising on the child and a broken jaw.Defense lawyer John Ruehrwein downplayed the incident in June, saying only two children actually witnessed the alleged incident.Ruehrwein said he was told the charge of assault and battery on a child with substantial injury would be reduced down and the case would remain in District Court.He said his client is a lifelong resident of Lynn, has no evidence of drug history and receives Social Security Disability income from an unspecified injury.
