SALEM – A New Hampshire man who was found guilty of stealing approximately $60,000 worth of gift cards from a Saugus clothing store where he was working will spend 18 months in jail and then be on probation.Louis Fagioli, 44, last known address of 87A Rockingham Road, Derry, N.H., was found guilty last month of larceny by false pretense in a jury-waived trial in Lawrence Superior Court before Judge Kimberly Budd, but sentencing was postponed.He was sentenced to a split term of two years in the House of Corrections Tuesday in Salem Superior Court, with all but 18 months suspended and placed on three years of probation when he is released by Judge Budd.The charge arises out of embezzlement scheme in which Fagioli, who was then the assistant manager of Casual Male XL, located at 87 Broadway in Saugus, stole approximately $60,000 in gift cards.Assistant District Attorney A.J. Camelio presented evidence that Fagioli stole the money through gift cards at the store between April 1, 2008 and May 20, 2009.An internal audit performed by the company discovered the discrepancies in 2009.Fagioli took the stand in his own defense at the bench trial, denying the allegation, but Budd was not convinced and found him guilty as charged.Fagioli hasn?t worked for the clothing store since 2009.
