SALEM – Lynn Community Access and Media, Inc. filed a court litigation Monday in Salem Superior Court seeking to recover $75,000 plus other damages from a lease agreement.Peabody Attorney Emmanuel Papanickolas filed the four-count court action on behalf of Lynn Community Access and Media, Inc., located at 104 Woodman St., Lynn, against the Greater Lynn Friends of Special Needs Citizens, Inc., located at 72 Keslar Ave. in Lynn.According to the court documents, on or about May 5, 2010, Greater Lynn Friends of Special Needs Citizens, Inc. leased premises at 104 Woodman St. for the complainants for $3,000 per month with an agreement to maintain the premises, specifically the roof, in good order and repair.The suit contends that they have “failed and refused” to repair and maintain the roof, resulting in a substantial number of leaks which have damaged the property and contaminated the building with “insidious mold.”Papanickolas accuses Greater Lynn Friends of Special Needs Citizens of breach of their commercial lease agreement, failing to pay for the repairs of the premises and failing to maintain the property in good working order.As a result, the complainants have had to expend $75,000 in order to repair and maintain the property and are asking a jury to review the case and award $75,000 in damages for the cost of repairs and maintenance to the property as well as actual damages to the personal property, consequential and incidental damages and costs.
