SALEM – A Lynn man police say they caught with approximately two ounces of heroin will have to come up with $5,000 cash bail in order to get out of the Middleton Jail pending trial.Edwin Diaz, 29, with addresses at 85 Newcastle St., #201, Lynn, and 6 Esmon St., Dorchester, appeared for his arraignment Wednesday, pleading innocent to trafficking over 28 grams of heroin.Judge David A. Lowy set the bail and continued the case to Dec. 9 for a pretrial hearing.On May 5, Lynn Police, along with a probation officer, went to Newcastle Street with a warrant to search the premises for items suspected stolen during a home invasion. Police also suspected the juvenile living in the home was involved.As police rummaged through the house, they found a jacket containing approximately 60 grams of heroin, a scale and documentation with Diaz?s picture.Diaz was not at the house at the time of the search and, according to reports, is the boyfriend of the juvenile?s mother and occasionally stayed at the home.Assistant District Attorney John B. Brennan asked for a $7,500 cash bail based on Diaz? prior record as well as the seven-year minimum penalty he faces if convicted.Defense lawyer Joseph Collins argued for $2,000 cash bail, arguing that the commonwealth “does not have a strong case,” while insisting that the jacket found does not belong to his client.He said Diaz lives in Dorchester and occasionally lives at his girlfriend?s home on Newcastle Street in Lynn. Collins also emphasized to Lowy that Diaz was not linked to the stolen goods found in the search.
