SALEM – A former Lynn man who admitted driving drunk for his fourth time earlier this year received three to three and one-half years in state prison, was fined $1,500 and will be losing his license for 10 years.Rocco V. Iudiciani, 52, last known address of 9 Ninth St., #405, Medford, changed his plea of innocent to guilty last week in Salem Superior Court, confessing to a charge of operating a motor vehicle while under the influence of alcohol, fourth or subsequent offense, before Judge Howard J. Whitehead.Iudiciani, a restaurant worker, was arrested on Route 1 southbound in Lynnfield on March 26, 2011 when he was stopped by police for erratic operation of a motor vehicle as he swerved, almost hitting a guard rail.The officer reported that he smelled a strong odor of alcohol on Iudiciani’s breath, that he stumbled getting out of the car and also failed several sobriety tests.Iudiciani finally told the officer he had a couple of drinks. His alcohol blood level was .13, according to reports.Iudiciani had three prior operating under the influence charges. His most recent was in 2001, according to reports.Whitehead agreed to postpone the sentence until Dec. 12. In the meantime, Iudiciani remains free on bail with conditions including a GPS motoring device.Assistant District Attorney Jane Prince prosecuted the case and Richard C. Bardi was the defense attorney.
