MARBLEHEAD – The state Department of Environmental Protection rejection of Peter Noyes? proposed gravel ramp from Gas House Beach to Gerry Island and his planned seawall repairs on the island will stand – and it may affect Noyes? Superior Court appeal as well.Noyes had 10 business days to appeal the DEP?s Nov. 10 decision or submit a new plan. That opportunity expired the day after Thanksgiving, with no appeals filed.The DEP decision was based on the state wetlands protection law, but Noyes must appeal the commission?s decision in Superior Court because that decision was based on Marblehead?s wetland protection bylaw.Town Counsel Lisa Mead, who represents the town in the court case, declined to discuss her strategy when the appeal comes before a judge.However, Mead said, “You need to have certain things in place for a successful court appeal. The town will take the appropriate steps to make sure its interests are protected. If Mr. Noyes has not maintained the necessary actions then the town will act accordingly.”Noyes is representing himself in the court appeal.
