PEABODY – The businessmen who are trying to open a Dunkin’ Donuts franchise at 79 Lynnfield St. have filed a lawsuit in Salem Superior Court appealing the second denial of a special permit for the establishment.Attorney Mark Bobrowski filed the suit to have a judge review the decision by the Peabody City Council, according to the lawsuit.The Peabody City Council voted 7-4 in favor of the special permit on Dec. 8, however, eight votes were needed for the permit to be allowed.The denial is the second rejection of the proposal in which the Dunkin’ Donuts would occupy a vacant unit in the plaza.
