LYNN – Police will charge the driver involved in a Saugus River car crash last month that killed a 24-year-old woman with motor vehicle homicide, Police Lt. Christopher Kelly said Tuesday.Kelly said police will file criminal complaints against Gerardo Brito, 60, of Dorchester, for motor vehicle homicide and operating under the influence in connection with the Dec. 5 accident that killed Santa de los Santos of New York City and left Brito in critical condition.Kelly said officers will take out complaints in Lynn District Court after Police Department traffic investigator Robert Leblanc finishes his report on the crash investigation later this week.Leblanc on Monday said the joint investigation by Lynn and State Police into the crash determined Brito had been drinking in Lynn before the crash and concluded that he may have suffered a stroke.”It doesn’t look like speed is a factor. He may have had a stroke before or during the accident,” Leblanc said.Police said Brito crashed his Mercedes on the Fox Hill Bridge shortly after 1 a.m. on Dec. 5 as he drove from Lynn into Saugus. The sports utility vehicle dropped into the Saugus River and four Lynn police officers rescued Brito. Responding Saugus and Lynn firefighters pulled Santos, the mother of two young girls, from the river. She was pronounced dead at Salem Hospital.Kelly said Brito was initially listed in critical condition at Brigham and Women’s Hospital, but Kelly said his condition improved sufficiently over the last month for Brito to answer investigators’ questions.A woman who answered calls to Brito’s hospital room on Tuesday refused to put him on the phone.Thor Jourgensen can be reached at [email protected].
