SALEM – A Superior Court judge has taken under advisement another motion by prosecutors to have Daryl Jones, the Lynn high school teenager charged in connection with the fatal stabbing of a man at Gallagher Park in 2010, provide a blood sample for analysis.Assistant District Attorney Michael Sheehan appeared in Salem Superior Court Tuesday, arguing that a DNA profile should be taken from Jones because human blood samples found on a car floor mat has two mixtures of blood and the majority of the source is the victim?s. But there is another mixture that should be analyzed and compared for evidence, Sheehan argued.?We need his DNA to match,” insisted Sheehan.The vehicle was seen leaving the scene by witnesses. Jones is the registered owner of the black car, according to Sheehan.But defense lawyer Lawrence J. McGuire strongly objected, saying it is an “intrusion” to his client to provide the blood, while insisting that “they do not need this evidence in their case and have not met the burden.”Judge Timothy Q. Feeley took the issue under advisement. This is the second motion that Sheehan has filed for a blood sample.Jones, now 18, of 11 Marianna St., Lynn, is charged with first-degree murder in connection with the fatal stabbing of Huy Le.Le, 19, of 64 Whiting St., was found by police around 9:30 p.m., on Feb. 12, 2010, at the Pine Hill?s Gallagher Playground, following a 911 call.According to court documents, Le was killed by Jaime Martinez, who also was 17 at the time, of Lynn, who fled the scene in Jones? car along with two other juveniles.
