MARBLEHEAD – The first development to use a 1990s incentive zoning bylaw is now in its second year of hearings, with still more questions to answer.John Muldoon applied for Planning Board approval last spring. The hearing began in April and the Planning Board has now allowed Muldoon’s lawyer, Attorney Paul Lynch, to withdraw that application without prejudice.Lynch pointed out that Planning Board member Karl Johnson, who participated in the past year’s hearings, is not seeking re-election to the board and will be replaced. He said Muldoon will reapply once a fifth board member has been chosen and the project is approved by the Conservation Commission.Meanwhile, the 20-unit condominium development at 151 Green St. is still before the commission, where an engineering review of the project has raised questions for Muldoon to answer. That hearing began in September, and the Planning Board held off on its decision until the commission reviewed the drainage issues at the property.Muldoon plans to build 10 structures at Green Street and West Shore Drive, seven on the street and three at the back of the lot, close to a marshy area. Two units will be affordable.The commission hearing has been continued to May 10. At a commission meeting Thursday evening Lynch said he met with Chairman Walter Haug and Conservation Officer William Lanphear earlier last week and revised plans were scheduled to be delivered to Lanphear’s office Friday.Haug reminded Lynch that their discussion also included fee payments. “We have to have that done before we continue,” he told Lynch.Outside the meeting Lynch said the amount of fees and the amount Muldoon owes has not been calculated yet. “There are town fees and state fees,” he said, “and they’re being recalculated.”
