SALEM – A Superior Court judge found the mother of a Lynn toddler not guilty this morning of charges she hurt her baby daughter in 2009, after defense attorneys in the case argued the prosecution did not present enough evidence for the case against her to go to the jury.Judge Howard Whitehead found Maely Quinones, 25, of Lynn, not guilty of assault and battery on a child and reckless endangerment of a child.Whitehead also found the baby’s father, Jose Aquino, 25, of Lynn, not guilty on one count of assault and battery on a child with substantial injury, but he remains on trial for a second count. The jury is expected to begin deliberations later today.Assistant District Attorney Kate MacDougall has alleged the parents shook the infant, Elianny Aquino, at least twice during the time between her birthday on May 22 and July 28, 2009, when she was taken to the hospital and found to have severe bleeding in her brain and behind her eyes.Read the complete story in Tuesday’s Daily Item.
