SAUGUS – A Supreme Judicial Court decision released today reversed an earlier trial court judgment in favor of three developers who contended the town of Saugus was wrong to charge them more than $670,000 in infiltration and inflow sewer fees, according to the decision.The decision came more than six years after a trial judge ruled the $670,460 paid by the developers in the case, was an “illegal tax.”?Because we conclude that the charge in this case has the requisite characteristics of a fee rather than an impermissible tax, we reverse the judgment and enter judgment for the town,” said SJC Chief Justice Roderick Ireland in the decision.Read the complete story in Saturday’s Daily Item.
