LYNN — A judge ordered a 47-year-old Lynn man held without bail after a prosecutor said the man assaulted, then later tried to repeatedly stab his stepson.
“The victim shut the door, believed the fight was over, when the defendant opened the door and was brandishing a knife,” Assistant District Attorney Katelyn Giliberti said in Lynn District Court Friday. “[The defendant] charged at him with a knife and kept trying to stab him again and again.”
Amilcar Dagraca, 47, of 87 Cottage St. #3, was arrested and charged with armed assault to murder; and assault and battery with a dangerous weapon; at 8:43 p.m. Thursday. A not-guilty plea was entered on his behalf.
Police responded to the Cottage Street address Thursday evening and found the victim with an open stab wound to the middle of his chest, according to a report by Lynn Police Officer Thomas Hazard.
The alleged victim told police that he had argued with Dagraca — who the alleged victim said was drunk — and Dagraca “took a swing at him,” according to the report. The alleged victim said he wrestled Dagraca to the ground and subdued him in a headlock. The alleged victim said he then went to his room, according to the report.
But the alleged victim told police Dagraca stormed into the room minutes later and began attacking the alleged victim with a knife, according to police. Giliberti said the two wrestled as Dagraca tried to stab the victim numerous times and the knife broke in the process. Only when that happened and the victim broke free did he realize that he had a wound, she told the court.
The alleged victim’s girlfriend told police the argument started when Dagraca did not close the door while using the bathroom, exposing himself to her, according to Hazard’s report.
The alleged victim was taken to Massachusetts General Hospital with injuries that did not appear to be life-threatening, according to Hazard’s report.
Giliberti requested Dagraca be held without bail pending a dangerousness hearing. She said attorneys had not been to interview the alleged victim with Boston on lockdown Friday due to the manhunt for the suspect in Monday’s bombing.
Public Defender Deborah McWade did not challenge the facts of the case, but requested attorneys have the right to argue bail at the hearing.
Judge Dominic Paratore granted McWade’s request and ordered Dagraca held without bail pending a dangerousness hearing scheduled for Thursday. Telephone numbers listed for Dagraca and his family were disconnected Sunday evening.
