Woman’s ex, brother charged with beating her and new boyfriend

LYNN – A judge ordered two men held without bail Wednesday after police said the two used a baseball bat to attack a woman and her new boyfriend while the couple were asleep with a baby.Police said one of the men was the woman’s ex-boyfriend and father of the child; the other man was the woman’s brother.”I was met by the caller ? who immediately asked me where the ambulance was,” Lynn Police Officer Michael Crosby wrote in a police report. “Stepping into the apartment it was clearly evident by the amount of blood on the floor that someone was severely injured.”Jose D. Castillo, 21, of 143 Cambridge St. #1, Worcester, was arrested on a warrant and charged with assault-and-battery with a dangerous weapon, two counts; violation of an abuse-prevention order; armed assault to murder; armed assault in a dwelling; and reckless endangerment of a child.Ricardo Diaz, 18, of 352 Maple St. #2, was arrested on a warrant and charged with assault-and-battery with a dangerous weapon, two counts; assault-and-battery; armed assault to murder; armed assault in a dwelling; and reckless endangerment of a child.A plea of not guilty was entered for each in Lynn District Court at their arraignments Wednesday.Police reported responding to a Franklin Street apartment at 4:45 a.m. Tuesday and found both the female and male alleged victims; the latter sitting in a chair and with his head, face and chest covered in blood.The male alleged victim, 37, was “conscious but not alert,” and had “a severe gash to his head,” police reported. He was taken to Massachusetts General Hospital.The female alleged victim, 19, told police that she had an argument with Diaz, her brother, the previous day about her relationship with her ex-boyfriend and father of her child, Castillo. The female alleged victim told police Diaz was asked to leave the apartment – which he had shared with her, the male victim and Diaz’ girlfriend.The female alleged victim told police she, the male alleged victim and the 2-year-old child were sleeping in the male victim’s room Wednesday when they were awaken by Diaz and Castillo standing over them.The female alleged victim said Castillo had an aluminum baseball bat and struck her and then began beating the male alleged victim in the head, police reported. The alleged female victim said Diaz took the baby from the room; then came back and held her down while Castillo beat her new boyfriend. She reported that she escaped downstairs to call police and heard three people leave the apartment. The female alleged victim said she believed her brother Diaz’s girlfriend was involved and a window to the apartment had been opened.Diaz’s girlfriend, however, told police she had nothing to do with the incident; awaking to hear a fight and then that Diaz handed her the baby, police reported.Police have not filed charges against Diaz’s girlfriend.Assistant District Attorney Erin Bellavia requested Wednesday that both men be held without bail pending a dangerousness hearing. Neither of the attorneys appointed for the defendants objected to the request.Judge Stacey Fortes scheduled the two to be held without bail until a July 2 dangerousness hearing.Cyrus Moulton can be reached at [email protected].
