More drug charges, $10G bail for Lynn man

LYNN – A city man charged with selling heroin and possession of crack cocaine was held on $10,000 cash bail for those charges and held without bail for possibly violating probation conditions set a week earlier when the man was arraigned for similar crimes.”Just a week ago he was arraigned on this other drug charge and here he is back,” Lynn District Court Judge James LaMothe said Monday. “I think at this point bail needs to be revoked in the prior case and I accept $10,000 for the new case.”Emery Sanders, 61, of 224 Washington St. #25, was arrested and charged with distribution of Class A heroin, subsequent offense; and possession with intent to distribute Class B crack cocaine, subsequent offense; at 12:25 p.m. Friday.Sanders was arrested and charged with possession of Class B drugs with intent to distribute, subsequent offense; violation of a city knife ordinance; and possession of Class A drugs, subsequent offense; at 8:20 p.m. Friday, July 5, according to the police log.Sanders pleaded not guilty to the July 12 charges at his arraignment Monday in Lynn District Court.”He says he is not distributing drugs in any way,” court-appointed attorney Loring Lincoln said.Lynn Police arrested Sanders at an Albany Street address last Friday on an Essex Superior Court warrant for defaulting on a charge of possession with intent to distribute Class A drugs, according to a report by Lynn Police Officer Kelly Aylward.Police who arrested Sanders said they recovered eight individually packaged twists of suspected crack cocaine in the defendant’s pocket. The victim of a recent non-fatal overdose also identified Sanders as the man who had sold him and his friend heroin, police reported.Assistant District Attorney Danielle Doherty-Wirwicz requested $10,000 cash bail for the new charges. She also requested bail be revoked on the July 5 charges where she said police observed Sanders pass something to a driver of a car and, upon searching Sanders, found an empty Mentos container that had the strong odor of crack cocaine and found Class A drugs.Lincoln requested bail not be revoked in the July 5 charges, describing the case as “basically police observed (Sanders) allegedly go to a car.” Lincoln said police also stopped the driver of the car and only found a crack pipe in her possession.”The supposed drug transaction has no substantiation at all,” Lincoln said. He requested a “modest bail” on the new charges.Judge James LaMothe accepted the Commonwealth’s recommendation, ordering Sanders held for a potential probation violation and setting $10,000 cash for the new charges.Sanders is scheduled to return to Lynn District Court Aug. 13.Cyrus Moulton can be reached at [email protected].
