Bail set at $100G for Marblehead child rape suspect

SALEM – A judge ordered $100,001 bail for a Marblehead man police say raped and molested a 6-year-old girl, and posted pictures of the incidents online, a little more than a week after the man posted bail for allegedly possessing child pornography.Raymond Depaula, 40, of 23 Puritan Road, Marblehead, was indicted by an Essex County Grand Jury on July 11 on multiple counts of aggravated and forcible child rape and posing a child in a state of nudity or sexual conduct. He was also indicted on charges of possession of child pornography and improper storage of firearms from his earlier arrest, according to Essex District Attorney spokesperson Carrie Kimball-Monahan.She said the cases will be combined.Depaula pleaded not guilty at his arraignment Monday morning in Salem Superior Court.Attorneys did not discuss the charges, and the charges were not read aloud in open court Monday.Instead, Assistant District Attorney Kate MacDougall announced she and Defense Attorney Michael Hickey had agreed to $100,000 cash bail for the first case – the charges of child rape – and $1 cash bail for the second case of the indictment.Depaula has been held without bail since his June 14 arraignment in Lynn District Court, where he was charged with child rape; indecent assault and battery on a child under 14; distributing child pornography; and posing a child in a sexual act.In that incident, Marblehead Police reported seeing explicit images of Depaula and a young girl posted on the Internet. Depaula had posted $20,000 cash bail for the possession of child pornography and weapons charges – for which he was arraigned in August 2012 – approximately a week earlier, court records show. Police said Depaula admitted he was the person in the photos and he told police the child was 6 years old at the time the pictures were taken.Depaula denied posting the pictures, however, telling police someone must have stolen the memory card from his camera.MacDougall said Monday that a Lynn judge ordered Depaula’s bail revoked on the possession of child porn charges; requiring he be held without bail for up to 60 days. Depaula also was held on $250,000 cash in Lynn for the new charges, MacDougall said.She requested the agreed-upon bail for the Superior Court cases. She also requested that Depaula have no contact – either directly or indirectly – with the alleged victim or his former wife, “something Mr. Depaula seems to not quite get.”Judge John Lu accepted the agreed-upon bail and scheduled Depaula to return to court Aug. 16.Hickey said outside the courtroom that he could not comment further on the case.
