Child rape suspect found after 3 years

LYNN – A judge ordered $5,000 cash bail for a city resident a prosecutor said posted $1,000 bail on a child rape charge and then disappeared for three years until a recent arrest on motor vehicle offenses.”If this was June 2010 I’d be inclined to $1,000,” Judge Joseph Jennings said Thursday in Lynn District Court in response to the public defender’s request for $1,000 cash bail to be reissued. “This is August 2013.”Jessy Estrada, 31, of 19 Nahant St. #2, was arrested and charged with operating a motor vehicle after a license suspension; driving with a child not in a car seat; and a default warrant for rape of a child; on Wednesday. He appeared in Lynn District Court Thursday where he was arraigned on those charges and a case from 2010 for two counts of a number plate violation. Pleas of not guilty were entered on Estrada’s behalf.Attorneys did not argue the facts in the two motor vehicle cases.But Assistant District Attorney Aimee Conway requested Estrada be held on $15,000 cash bail for the child rape charge.Conway told the court that in 2010, a 14-year-old girl told a nurse at Lynn Community Health Center that she had sex with Estrada. Estrada was 27 years old at the time, Conway said.According to a report by Lynn Police Officer Cristine Petruzziello, the alleged victim told police “Jessy” had paid an 11-year-old boy to ask the alleged victim and her friend for their phone numbers. Estrada called only her, the alleged victim said. She told police Estrada told her he was 17; then admitted to being 19, then to being 21.”But she thinks he is around 25 years old,” police said.Estrada denied having sex with the alleged victim but admitted she did kiss him once, according to the report. He also admitted he was an immigrant living in the United States illegally, according to police.A prosecutor requested $15,000 cash bail at Estrada’s May 2010 arraignment on the child rape charge, Conway said. Judge Ellen Flatley set $1,000 cash bail, according to court documents. Estrada posted and then forfeited the bail when he failed to show up for his next court date, according to court documents.”He has two completely different names, we don’t know which is correct ? and he’s been in default for more than three years,” Conway said, requesting bail in the original suggested amount of $15,000. “It’s clear there needs to be a higher amount of bail.”Public Defender Tom Pierce, however, said the alleged victim gave two stories. Pierce noted the alleged victim first told police she and Estrada had only kissed. It was when pressured by the officer that the alleged victim said she and Estrada had sex, Pierce said.He also said there was no witnesses other than the complainant and Estrada denied they had sex. He asked that the $1,000 cash bail be reimposed.Jennings ordered $5,000 cash bail and that Estrada stay away and have no contact with the alleged victim. He scheduled Estrada to return to court Sept. 5.
