Lynn man charged with indecent assault and battery; bail set at $5G

LYNN – A judge ordered $5,000 cash bail without prejudice for a city man whom a woman said gave her pills and sexually assaulted her, according to court documents.”(The alleged victim) started to yell at the man ?how could you have done that to me?” Lynn Police Officer Roger Tinkham reported. “(The alleged victim) stated that she was positive that was the man that was in bed with her this morning when she woke up naked.”Miguel Espinal, 34, of 24 Mall St. #1, was arrested and charged with indecent assault and battery on a person 14 or over at 5:46 p.m. Sunday.Espinal was arraigned on the charge Monday in Lynn District Court where a plea of not guilty was entered on his behalf.Court records do not include a police report of the alleged indecent assault. Reasons for ordering bail, however, included that the defendant allegedly gave pills to the alleged victim and part of the assault was witnessed by the alleged victim’s friend, according to court documents.Court records also include an account of the arrest.Police reported they were on Mall Street when the alleged victim of a sexual assault report that the officers had taken earlier that day approached.Officers reported the alleged victim said she had seen the man who allegedly assaulted her and called police. The man identified himself as Espinal, police said.Police arrested Espinal for indecent assault and reported further charges may be filed pending the results of a rape kit.Espinal denied the charge, stating “he did not do anything with that girl,” according to the police report. Police also reported Espinal’s family members said the alleged victim “was crazy and doing drugs.”Judge Matthew Machera ordered Espinal held on $5,000 cash without prejudice, meaning the bail amount can be argued again, according to court documents.Espinal is scheduled to return to court Sept. 10 for a pretrial hearing. An attorney appointed to Espinal’s case could not be reached for comment on Wednesday afternoon.
