LYNN – A Lynn District Court jury convicted a city man of motor vehicle homicide related to a 2010 fatal accident on the Lynnwaythat engulfed a tow truck and a car in flames.
Derek Gallien, 26, of 1 Parkland Ave., was convicted Monday of motor-vehicle homicide by negligent operation and was found responsible for failure to stop/yield and speeding.
Gallien was sentenced by Judge Stacey Fortes to 2? years in jail with one year to be served and the balance suspended for three years with supervised probation. He was also sentenced to 300 hours of community service; to complete a National Driver Safety program; to undergo a mental health evaluation; and his driver’s license was revoked for 15 years.
Gallien was the driver of a tow truck that rear-endeda Honda Civic at the intersection of Hanson Street and Lynnway at approximately 4:30 p.m. July 30, 2010. The crash killedEdward Ma, 23, who was a backseat passenger in the Civic.
Both vehicles caught fire. Gallien, the Civic’s driver and a front seat passenger in the car all escaped with minor injuries.
The trial began last Monday. The jury of five women and three men returned a guilty findings Monday morning.
