Malden man charged with child rape

LYNN – A judge set $10,000 cash bail for a Malden man who allegedly raped a 15-year-old girl while he was dating the child’s mother.”The defendant told her as he was raping her in the bedroom, ?this feels right,'” Essex Assistant District Attorney Shailagh Kennedy said in Lynn District Court Tuesday.John J. Martori, no current address, was arrested on a warrant for rape of a child with force.He was arraigned on the charge Tuesday afternoon where a plea of not guilty was entered on his behalf.A 15-year-old girl and her mother reported to police recently that Martori had raped the girl early in the summer, according to a report by Lynn Police Officer Christine Petruzziello.The alleged victim told police Martori would make inappropriate remarks about her body, tell her he wanted to marry her and had tried to kiss her, according to the police report.The alleged victim told police Martori came into her room one night while she was watching television, according to police. Martori allegedly got on top of the alleged victim and, despite her protests, “in the victim’s words, ?continued to keep going,'” Kennedy told the court. The alleged victim said Martori penetrated her for about a second, Kennedy said.Kennedy said the alleged victim told her mother about the alleged assault after Martori broke up with the mother.Kennedy requested $25,000 cash bail, noting Martori’s record includes a guilty conviction for child endangerment. Kennedy also requested that include 24-hour GPS monitoring, home confinement and that Martori have no contact with and stay away from the alleged victim and her mother, and have no unsupervised contact with anyone under 18 should Martori post bail.Public Defender Tom Pierce said the commonwealth’s case “does not appear to be strong,” however.”There is no corroborating physical, medical, forensic evidence ? no corroborating witnesses,” Pierce said. “It’s essentially one report made by a young lady two months after the alleged incident and no explanation for why.”He said Martori had “brushes with the law,” but nothing similar to the charge he now faces. Pierce requested $500 bail, saying Martori was an electrician in Malden and could not afford more.Judge James LaMothe set bail at $10,000 cash and ordered Martori not to have contact with the alleged victim or her mother. Martori is scheduled to return to court Nov. 15.
