December 20, 2013 by [email protected]

LYNN – The Commonwealth dismissed charges against a city man police said beat a child for wetting the bed, after nobody showed up to testify against the defendant.Evens Calixte, of 9 Mall St. #1, was arrested on a warrant for assault and battery with a dangerous weapon; and assault and battery on a child with injury in August. He had pleaded not guilty to the charges.Police responded to the Mall Street apartment where a woman reported Calixte had hit her grandchild with a belt. The alleged victim’s mother told police Calixte hit the child because the child wet the bed then hid the dirty sheets and clothing, according to police. Officers reported the child had welts and bruises on his back, and told officers Calixte had hit him, but would not elaborate on any details. The charges were dismissed without prejudice, meaning they can be brought again if new evidence is found, when no one showed up to testify in the case, according to a spokesperson from Essex District Attorney Jonathan Blodgett’s office. Judge Albert Conlon accepted the dismissal.
