LYNN – A judge ordered a city man held without bail pending trial after police said the man strangled his girlfriend, left the home and then – while police were searching for the defendant – returned and attacked the victim again.”While writing this report, dispatch then informed me that the victim was now calling 911 again to report (the defendant) had returned,” Lynn Police Officer Rodolfo Ramirez wrote in a report. “(The victim) was again crying and hysterical stating that (the defendant) barged through the door and began screaming at her and then threw her on the ground.”Carmet Cruthird, 66, of 37 Amity St. #1, was arrested and charged with assault and battery, two counts; at 3:22 p.m. Monday. He pleaded not guilty to the charges at his arraignment Tuesday in Lynn District Court but was held without bail pending a dangerousness hearing.Police responded to the Amity Street address twice Monday afternoon on reports of an unwanted guest, according to a report by Lynn Police Officer Rodolfo Ramirez.The alleged victim told police Cruthird abused her and had just grabbed her throat trying to strangle her before throwing her across the floor, according to police. The alleged victim told police Cruthird was an alcoholic and had abused her in the past. Police said two witnesses in the home corroborated the alleged victim’s account.Police reported the alleged victim had no visible injuries and refused treatment but said she was afraid Cruthird would return to the apartment. Police said officers put out a “Be on the Lookout” for Cruthird but reported not being able to find the suspect in the immediate area.When police returned to the home on the second call, the alleged victim said Cruthird had returned and again threw her to the ground. The alleged victim told police responding officers prevented Cruthird from assaulting her further. Police arrested Cruthird at the scene.Cruthird stipulated to being found dangerous at his dangerousness hearing Thursday afternoon in Lynn District Court. But court-appointed defense attorney Michael Dunphy objected to prosecutor Erin Bellavia’s request that Cruthird be held without bail pending trial.Dunphy requested Cruthird be released on GPS. Dunphy said Cruthird had no record of convictions in domestic charges and “pleaded out and did an awesome job in probation” on a prior assault case in which Cruthird said he had been jumped.Bellavia said Cruthird’s record included violating restraining orders and that the alleged victim told police the strangulation was so serious that she tried to scream but couldn’t breathe.Judge Cesar Archilla cited Cruthird’s six-page record and history of six previous restraining orders in ordering the defendant held without bail pending trial. Cruthird is scheduled to return to court April 10.
