Lynn danger hearing argument ends in man hit by car

LYNN – The question of dangerousness apparently continued outside the courtroom Thursday after police said a dispute during a dangerousness hearing led to a Randolph man driving into another man on Sutton Street.”He appeared to purposefully hit this party, and then tried to drive away and was arrested,” Lynn Police Lt. Rick Donnelly said Thursday afternoon.Herve Viaud, 23, of 90 Cross St., Randolph, was arrested Thursday afternoon and charged with assault and battery with a dangerous weapon, a car; and possession of a firearm without a firearms identification card.Donnelly said a 20-year-old black man had minor injuries to his leg from the incident and was taken to Union Hospital.The crash stemmed from disputes during a dangerousness hearing at Lynn District Court Thursday involving Viaud’s brother, Luis Viaud, 24, of Dorchester.Luis Viaud was held without bail pending the hearing after police said Luis Viaud strangled his child’s mother on Aug. 24 and then threatened to burn down the shelter where she and the child were staying if she called police.Police did not note any injuries to the alleged victim on Aug. 24, however, and the courtroom was tense and confrontational as the alleged victim testified she had been injured on that day and told the court Luis Viaud had abused her in the past.”Remove the smirk from your face,” Lynn District Court Judge Cathleen Campbell ordered the defendant at one point, saying she was tired of his constant smirking throughout the alleged victim’s testimony.”I wasn’t smirking, your honor,” Luis Viaud replied nervously. “I just have cold teeth.”Friends and relatives of both the alleged victim and the defendant began arguing in the hallway after Campbell ordered the case put on for a further call.The dangerousness hearing continued that afternoon. So did the disruption.Donnelly said Herve Viaud was ordered to leave the courthouse as a result of a disruption during the afternoon court session. The dispute allegedly reignited by the court parking lot on Sutton Street and somebody called police. As officers arrived on scene, Herve Viaud got into his car and ran over a 20-year old-man who got in front of the vehicle to prevent Herve Viaud from leaving, police said.Police quickly arrested Herve Viaud and recovered a gun in his car, Donnelly reported. He said Herve Viaud did not have a firearms identification card for the weapon.Meanwhile, Campbell found Luis Viaud to be a danger and ordered him held on $1,000 cash bail, according to defense attorney Arthur Carakatsane. Campbell ordered conditions of release including that Luis Viaud stay away from and have no contact with the alleged victim, abide by a restraining order and remain drug and alcohol free.Herve Viaud is expected to return to Lynn District Court today for his arraignment and, since the charges involve a firearm, will likely eventually appear in gun court before Judge Campbell.
