LYNN – Joshua Grout, 19, of 46 Grove St., was arraigned in Lynn District Court on a pretrial hearing Tuesday and released on $1,000 cash bail on several charges.Grout was arrested and charged with larceny from a person; malicious destruction of property, $250+; and assault and battery stemming from an incident earlier this spring.Grout is scheduled to appear again in court July 21 at 9 a.m. for a discovery compliance and jury election.According to police reports, a fight broke out when Grout asked Andrew Dunmire of Lynn for a cigarette, and Dunmire refused to give him one. Grout then assaulted him to grab the cigarettes out of Dunmire?s pocket, police said, adding that Grout also damaged a 14-year-old boy?s fishing rods during the altercation.Judge Albert S. Conlon ordered Grout to stay away from the victims.Originally charged with unarmed robbery, the charge was amended and reduced to larceny, according to Carrie Kimball Monahan, Essex District Attorney spokeswoman.According to Lynn Officer Taylor Kulakowski, Grout also gave a false name and caused a disturbance while inside the cruiser. Kulakowski said the victims didn?t know Grout before the assault occurred.According to court documents, the penalty for malicious destruction of property $250+ includes: state prison not more than 10 years, or jail not more than 2 ? years, and a $3,000 fine, or three times the value of the destroyed property. For assault and battery, the penalty is in the house of correction not more than 2 ? years or not more than a $1,000 fine.
