LYNN — A man who was arrested this week for an assault that took place on Saturday at a Shell Station on the Lynnway is no longer a suspect.
The Essex County District Attorney’s office said Randy Spearing, 49, of Lynn was released from the Essex County House of Corrections in Middleton because his arrest stemmed from a case of mistaken identity.
On Friday, Spearing said he is active in the community working on addiction recovery causes.
“All I want is my name cleared,” he said. “I’m torn up. I want to move past it.”
Carrie Kimball-Monahan, a DA spokeswoman, said Spearing was arrested based upon the victim’s initial statement.
“Upon receiving further information from the victim, who was badly injured in the attack, police conducted a further investigation and concluded that Mr. Spearing was not the man suspected in this attack,” Kimball-Monahan said in an email. “Police immediately notified an assistant district attorney of the mistaken identity. That assistant district attorney promptly went to court to … request that Mr. Spearing’s record be expunged of the charges and that the Sheriff’s Department be notified to ensure Mr. Spearing’s release.”
