LYNN — An Everett man has been charged with murder and armed robbery following a fatal shooting that occurred on Memorial Day.
Nick Volmar, 29, was arraigned in Lynn District Court Monday afternoon and charged for the death of Brian Poitras, 35, of Lynn. He pleaded not guilty and is being held without bail.
At 8:39 a.m. May 31, police responded to a report of a shooting at 234 South Common St., where Poitras lived. Poitras, who had been shot in the torso, was brought to Massachusetts General Hospital, where he was pronounced dead.
According to prosecutors, Poitras and several witnesses were in his apartment smoking marijuana when there was a knock on the door. Poitras answered and found a man later identified as Volmar, who said he wanted to purchase $70 worth of marijuana. Witnesses said that Poitras appeared to know the visitor, as he let him into the apartment.
An argument ensued and the suspect pulled out a handgun and told everyone to get down on the ground. He shot Poitras, took a black tackle box that belonged to the victim and fled the scene, prosecutors said.
Police were able to identify from surveillance footage a 2003 Mazda Tribute that they believed belonged to the suspect. A search identified 11 such vehicles registered on the North Shore, only one of which was registered to a Black man who matched the suspect’s description as given by witnesses, prosecutors said.
Police were able to track the car to Volmar’s residence. Volmar was arrested Monday morning.
Volmar will next appear in court on Wednesday, June 22.
