A Proposed Ordinance Amending the City of Lynn Zone Ordinance Regulating Permitted Uses and Dimensional and Parking Regulations in all Zoning Districts in the City of Lynn
Notice is hereby given that the Planning Board of the City of Lynn will hold a public hearing on Tuesday, December 13, 2022, at 4:00 o’clock p.m. in Room 302, Lynn City Hall, 3 City Hall Square, Lynn, MA 01901 on the proposed Zoning Amendments summarized below. Notice is hereby given that the Lynn City Council of the City of Lynn will also hold a public hearing on Tuesday, December 13, 2022 at 5:30 o’clock p.m. in Council Chambers, Lynn City Hall, 3 City Hall Square, Lynn, MA 01901 on the proposed Zoning Amendments summarized below.
A Proposed Ordinance Amending the City of Lynn Zone Ordinance Regulating Permitted Uses and Dimensional and Parking Regulations in all Zoning Districts in the City of Lynn. These proposed Zoning Amendments are designed to promote and foster greater affordable housing stock/supply and to promote greater economic development in the City of Lynn. The proposed Zoning Amendments include proposed changes to both Section 4 (“TABLE OF USES REGULATIONS”) for currently permitted or regulated Residential, Business, and Industrial Uses and Section 8 (“TABLE OF DIMENSIONAL REGULATIONS”) in the WF1, WF1A, WF2, WF3 and WF4 Zoning Districts. The proposed Amendments also include new uses not previously permitted or regulated by the existing Zone Ordinance, including but limited to “Small Scale Manufacturing.” The proposed Amendments also includes new definitions, including but not limited to new definitions of “Micro-Brewery, Distillery and Winery” and “Retail Trade Custom Workshop.” The proposed Zoning Amendments further amends Section 12 (“SPECIAL PERMITS”) and defines the information and documentation that must be included in the Special Permit Application and adds new uses which will require a Special Permit in all Zoning Districts in the City of Lynn. The proposed Zoning Amendment further eliminates Footnotes to Section 4 (“USE REGULATIONS”) applicable to the WF1, WF1A, WF3, WF4, WS, and SHCO Districts. The Zoning Amendments will amend Section 2:00 of the Zone Ordinance (“DEFINITIONS”) to include definitions establishing and regulating Affordable Housing requirements that effect all Zoning Districts in the City of Lynn. The proposed Zoning Amendments would create a new Section 23 (“AFFORDABLE HOUSING”) which would establish regulations and requirements for affordable housing in all Zoning Districts in the City of Lynn on projects of a certain size and scale. The requirements will establish different affordability criteria for the Central Business District, the Waterfront Districts and the Greater Lynn District (all non-Waterfront/CBD Districts). The proposed Section 23 will also establish alternative methods for compliance with the newly created housing affordability requirements. The proposed Section 23 will further establish regulations, including but not limited to regulations for the design and construction of affordable units; affordable housing compliance requirements (including tenant selection requirements); and incentives for affordable units which will provide relief from the provisions of Section 9 (“OFF-STREET PARKING REQUIREMENTS”). These incentives will result in amendments to the parking requirements in all Zoning Districts in the City of Lynn in Section 9 (“OFF-STREET PARKING REQUIREMENTS”). Section 23 will also provide for a review and approval process of projects where the affordable housing requirements are applicable. The proposed Zoning Amendments and a Map of the Zone Ordinance with a list of those properties which will be effected is available for review, inspection and copying during normal City Hall hours at the City Clerk’s Office, Room 201, Lynn City Hall, 3 City Hall Square, Lynn, MA 01901 commencing at 8:30 a.m. Tuesday, November 29, 2022. The proposed Zoning Amendments which will result in amendments to all Zoning Districts in the City of Lynn will also be available on the City of Lynn website commencing at 8:30 a.m. Tuesday, November 29, 2022.
IN-PERSON PUBLIC COMMENT: All persons interested in presenting public comment at the meeting are welcomed to attend the public hearings of both the Planning Board and the Lynn City Council.
